📄 General Terms and Conditions (GTC)

1. Scope

These General Terms and Conditions (GTC) apply to all orders placed by consumers within the European Union (EU) through the online store “StretchCurls.”

A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed (§ 13 BGB).

3. Conclusion of Contract

The product listings in the online store do not constitute a legally binding offer but an invitation to place an order.

By clicking the “Buy Now” button, you make a binding offer to purchase. The contract is concluded when you receive an order confirmation by email.

The contract text is not stored permanently by us. However, the order data can be viewed and saved from the confirmation email.

Contracts can be concluded in German or English, depending on your language selection during checkout.

4. Prices and Payment

All prices are final prices according to § 19 UStG (Small Business Regulation) and do not include VAT.

The purchase price is due upon conclusion of the contract. Payment is made via the payment methods offered in the online shop.

5. Delivery

Delivery is made to the address you provide within the European Union.

Shipping is handled by reliable logistics partners. Estimated delivery times are shown on the individual product pages.

Please ensure your delivery address is complete and correct. Additional costs due to incomplete or incorrect addresses are your responsibility.

6. Retention of Title

The goods remain our property until full payment is received.

7. Right of Withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period begins on the day you or a third party (not the carrier) receives the goods.

To exercise your right, you must send a clear statement via email or use the withdrawal form available on our website.

8. Return Costs

If you exercise your right of withdrawal, you are responsible for the direct costs of returning the goods.

Returns sent without postage (e.g., “postage paid by recipient”) will not be accepted.

Please note the hygiene policy under section 9.

9. Exclusion or Expiry of the Right of Withdrawal for Hygiene Products

The right of withdrawal does not apply to sealed hygiene products if the seal has been removed after delivery (§ 312g para. 2 no. 3 BGB).

Our hairnets are classified as hygiene products because they come into direct contact with hair and scalp.

Withdrawal is only possible if the original packaging is unopened and undamaged.

10. Warranty

Statutory warranty rights apply.

Please inspect goods upon delivery for obvious transport damage and report any issues to the courier and to us immediately. This is helpful for claims but not a prerequisite for exercising your legal rights.

11. Liability

We are liable without limitation in cases of intent or gross negligence.

For simple negligence, we are liable only for breaches of essential contractual obligations (“cardinal duties”) and only for foreseeable damages typical to the contract.

12. Online Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR):

We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

14. Final Provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

Mandatory consumer protection laws of your country of residence remain unaffected.

If any provision of these GTC is found invalid, the remainder of the terms remain valid.
